Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Dental Capital platform ("Platform"), operated through the website dentalcapitaloftheworld.com. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

  • "Platform" refers to the Dental Capital website at dentalcapitaloftheworld.com and all associated services, features, and content.
  • "User" refers to any individual or entity that accesses or uses the Platform, including Patients and Clinics.
  • "Patient" refers to a User who uses the Platform to search for, compare, or contact dental clinics.
  • "Clinic" refers to a dental practice, clinic, or professional that lists its services on the Platform.
  • "Content" refers to text, images, reviews, ratings, data, and any other material submitted to or displayed on the Platform.
  • "Services" refers to the dental treatments and procedures offered by Clinics to Patients.

2. Nature of the Platform

2.1 Marketplace and Information Platform

Dental Capital is an information and marketplace platform that connects Patients with dental Clinics. We are not a healthcare provider, dental clinic, medical professional, or insurance company. We do not provide, perform, or guarantee any dental treatments, medical procedures, or health services.

2.2 No Doctor-Patient Relationship

Use of the Platform does not create a doctor-patient, dentist-patient, or any other healthcare provider-patient relationship between you and Dental Capital. Any healthcare provider-patient relationship exists solely between the Patient and the Clinic they choose to engage.

2.3 No Medical Advice

Information published on the Platform — including treatment descriptions, price comparisons, blog articles, and guides — is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment recommendations. Always consult a qualified dental professional before making healthcare decisions.

3. Limitation of Liability

3.1 Dental Treatments and Outcomes

Dental Capital is not responsible for the quality, safety, legality, or outcome of any dental treatments, procedures, or services provided by Clinics listed on the Platform. This includes, but is not limited to:

  • The accuracy of clinic profiles, credentials, certifications, or qualifications
  • The quality of dental materials, equipment, or techniques used by Clinics
  • Treatment outcomes, complications, side effects, or adverse reactions
  • Misdiagnosis, treatment errors, or malpractice by Clinics or their staff
  • The validity of warranties or guarantees offered by Clinics
  • Pricing accuracy — actual prices may differ from those displayed on the Platform

3.2 Travel and Personal Safety

Dental Capital is not responsible for any incidents, injuries, losses, or damages that occur during your travel to, from, or within any destination for dental treatment. This includes, but is not limited to:

  • Transportation accidents or delays
  • Theft, assault, or other criminal acts
  • Border crossing issues, visa problems, or immigration matters
  • Hotel or accommodation issues
  • Natural disasters, pandemics, or political instability
  • Any losses or damages of personal property

3.3 Maximum Liability

To the maximum extent permitted by applicable law, Dental Capital's total liability to any User for all claims arising out of or related to the Platform shall not exceed the amount paid by the User to Dental Capital in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

3.4 Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

4. User Responsibilities

4.1 Due Diligence

Patients are solely responsible for performing their own due diligence before engaging any Clinic, including:

  • Verifying clinic credentials, certifications, and licenses independently
  • Researching the Clinic's reputation through multiple sources
  • Obtaining and understanding a detailed treatment plan before consenting
  • Confirming all pricing, payment terms, and warranty conditions in writing
  • Consulting with their own healthcare providers before undergoing treatment
  • Obtaining appropriate travel and medical insurance
  • Understanding the legal framework for medical malpractice in the destination country

4.2 Clinic Responsibilities

Clinics listed on the Platform agree to:

  • Provide accurate, truthful, and up-to-date information in their profiles
  • Hold all required licenses and certifications for their jurisdiction
  • Comply with all applicable local, national, and international healthcare regulations
  • Provide transparent pricing without hidden fees
  • Respond to patient inquiries in a timely and professional manner
  • Not engage in deceptive, misleading, or fraudulent practices

4.3 Account Security

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You must notify us immediately of any unauthorized use of your account.

5. Prohibited Conduct

Users may not:

  • Submit false, misleading, or fraudulent information, reviews, or ratings
  • Impersonate another person or entity
  • Use the Platform for any illegal purpose or in violation of applicable laws
  • Harass, abuse, threaten, or intimidate other Users
  • Attempt to access another User's account without authorization
  • Scrape, crawl, or use automated tools to extract data from the Platform without written permission
  • Upload viruses, malware, or other harmful code
  • Circumvent, disable, or interfere with security features of the Platform
  • Use the Platform to spam, advertise, or solicit Users outside the Platform
  • Submit fake reviews, manipulate ratings, or engage in review fraud

6. Reviews and User Content

6.1 Review Policy

Users may submit reviews and ratings of Clinics. Reviews must be based on genuine personal experiences. We reserve the right to remove reviews that are fraudulent, defamatory, abusive, irrelevant, or that violate these Terms.

6.2 Content License

By submitting Content to the Platform, you grant Dental Capital a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, display, and distribute such Content in connection with operating and promoting the Platform.

6.3 Content Ownership

You retain ownership of Content you submit. However, you represent and warrant that you have the right to submit such Content and that it does not violate any third-party rights.

7. Intellectual Property

The Platform, including its design, code, text, graphics, logos, and other content created by Dental Capital, is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our intellectual property without our written consent.

8. Indemnification

You agree to indemnify, defend, and hold harmless Dental Capital, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any Content you submit to the Platform
  • Any dispute between you and a Clinic
  • Any dental treatment or procedure you receive through Clinics found on the Platform

9. Dispute Resolution

9.1 Between Users

Dental Capital is not a party to any agreement or dispute between Patients and Clinics. Any dispute regarding dental treatment, pricing, quality, or outcomes must be resolved directly between the Patient and the Clinic. Dental Capital may, at its sole discretion, assist with mediation but is under no obligation to do so.

9.2 With Dental Capital

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with applicable laws. Before initiating arbitration, the parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days.

10. Account Termination

We reserve the right to suspend or terminate any User account at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or abusive behavior. Upon termination, your right to use the Platform ceases immediately.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms. We recommend reviewing these Terms periodically.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Dental Capital regarding the use of the Platform, superseding all prior agreements or communications.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable international commercial laws. For Users located in specific jurisdictions, additional local consumer protection laws may apply to the extent they cannot be excluded by contract.
